Terms and Conditions Agreement for Malaga Gastronomia y Desarrollo SL, trading as Spain Food Sherpas:
Please read the following Terms and Conditions carefully before booking any tours or classes with Malaga Gastronomia y Desarrollo SL, trading as Spain Food Sherpas (“us,” “we,” or “our”). By booking any tours or classes, you agree to be bound by these Terms and Conditions.
PURCHASES
All purchases made through our website or over the phone through customer service are subject to the following Terms and Conditions. In any and all bookings, the person making the booking shall be deemed to have accepted these conditions on behalf of the guest(s) named in the booking. No variation to these Terms and Conditions shall be of any effect unless made in writing by and with the authority of the company.
PAYMENTS
We are able to accept the following payment methods: Visa, Mastercard, Paypal, Google Pay, and Apple Pay. We require all payments to be made in full in order to confirm your booking.
All tours and classes are provided by Malaga Gastronomia y Desarrollo SL, trading as Spain Food Sherpas. Upon release of payment and guarantee of booking, all guests submit 100% compliance to the following Terms and Conditions. Should any doubt or dispute with said Terms and Conditions arise before booking, guests are requested to contact us before confirming a booking.
CURRENCY
Tours listed on our site are displayed and priced in euros unless otherwise noted at the top of the page or as selected by the user. Guests accept any and all fees associated with booking tours using a credit card. Rates found online are the basis for our rates, but may not be the same as our rates. Our rates are updated daily and may be slightly higher or lower than those found online. The FX rate at which we sell our tours is non-negotiable.
PROMOTIONAL CODES
If you are in possession of a discount code or promo code, it must be used at purchase. Discount and promo codes cannot be used retroactively and they cannot be stacked, consolidated, transferred, or re-used unless otherwise noted. All promotional codes have an expiration date, whether explicit or not. Expiration dates are set at 1 year from issuance when no date is explicitly noted.
CANCELLATIONS
Public Tours/Classes:
Free cancellations or date changes (subject to availability) are allowed up to 24 hours before it starts. No refund will be provided for cancellations made within 24 hours of a tour/class, or in case of no-show. If you have paid a deposit for your activity, the deposit amount is non-refundable.
Flamenco Tours that include the tickets to the show.
Free cancellations or date changes (subject to availability) are allowed up to 48 hours before it starts.
25% cancellation fee if the cancellation is made less than 48h before the start.
No refund will be provided for cancellations made within 24 hours of a tour, or in case of no-show.
Private Activities:
Free cancellations or date changes (subject to availability) are allowed up to 48 hours before it starts. 50% cancellation fee applies if the cancellation is made less than 48 hours before the start. If you have paid a deposit for your activity, the deposit amount is non-refundable. Please notify us of your cancellation or date change via email at hello@spainfoodsherpas.com.
Refund Processing Time: We submit refunds as soon as we receive a cancellation. Depending on the bank’s processing time, it can take anywhere from 3-10 business days to show up on your bank account. Gift cards are not refundable.
REFUNDS ON UNUSED SERVICES
All Spain Food Sherpas tours and classes are sold as an entire package; as such, there will be no offers of partial refunds for portions of a service that a guest has decided not to use.
A booking is considered successfully canceled or amended only after Malaga Gastronomía y Desarrollo SL sends successful notification via email and cancellation/amendment fees are applied.
LIABILITY
Malaga Gastronomía y Desarrollo SL, its websites, brands, subsidiaries, affiliated entities, employees, and agents operate solely as intermediaries between the customers and the various suppliers who provide transportation, accommodation, sightseeing, activities, and other services related to any booked tours. These services are subject to the suppliers’ own terms and conditions. Malaga Gastronomía y Desarrollo SL and its employees have no ownership or control over any supplier of goods or services and assume no responsibility for, and cannot be held liable for, any injury, death, property damage, or other loss, accident, delay, inconvenience, or irregularity caused by (1) sickness, weather, strikes, hostilities, wars, terrorist acts, acts of nature, local laws, or any other such causes; (2) the wrongful, negligent, willful, or unauthorized acts, defects, omissions, or defaults of any of the tour suppliers or other employees or agents who provide these services; (3) any defect or failure of any vehicle, equipment, or instrument owned, operated, or otherwise provided by these suppliers; or (4) any wrongful, willful, or negligent act or omission by any other party not under the direct supervision, control, or ownership of Malaga Gastronomía y Desarrollo SL. All services and accommodations are subject to the laws and regulations of Spain, where they are provided. Malaga Gastronomía y Desarrollo SL is not responsible for any baggage or personal belongings of any individual who participates in the tours or trips arranged by Malaga Gastronomía y Desarrollo SL. Each individual traveler is responsible for purchasing a travel insurance policy, if desired, that will cover some of the expenses associated with the loss of luggage or personal effects.
Participants must inform us of any dietary requirements or allergies at the time of booking. While we cannot guarantee that the food served on our tours will be free of allergens, especially regarding cross-contamination and/or airborne allergens, and even if we order food that is suposed not to contain any ingredients the customer is allergic to, we will try our best to make sure our suppliers accommodate our customers’ dietary requirements.
Although the company and the website endeavor to provide accurate and up-to-date information, we make no representations or warranties as to the accuracy of the content and assume no liability or responsibility for any errors or omissions in the content. The company and the website do not represent or warrant that the use of any content will not infringe on the rights of third parties inadvertently. The company and the website have no responsibility for the actions of third parties or for content provided or posted by others. The use of the website is at your own risk. All content is provided “as is” and “as available.” The company, the website, their affiliated or related companies, and any current or former employees, officers, agents, content providers, or licensors do not make any representation or warranty of any kind regarding the website, the content, any advertising material, information, products or services available on or through the website, or the results that may be obtained from using the website or such content or services. We specifically disclaim all express or implied warranties, including without limitation warranties of merchantability and fitness for a particular purpose, warranties against infringement, and warranties that the website will meet your requirements, be uninterrupted, timely, secure, or error-free. The company, the website, and their affiliates are not responsible or liable for any content posted by third parties, actions of any third party, or for any damage to, or virus that may infect, your computer equipment or other property.
In no event shall the company, the website, including their affiliates, employees, officers, agents, content providers, and licensors, be liable for any indirect, consequential, special, incidental, or punitive damages, including without limitation damages related to unauthorized access to or alteration of your transmissions or data, the content of the website, or any errors or omissions in the content, even if advised of the possibility of such damages.
APPLICABLE LAW AND JURISDICTION
These Terms and Conditions shall be governed by and construed in accordance with Spanish law. Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the Spanish courts.
